These Terms and Conditions (“Terms”) govern access to the SwarnaSakhi website and mobile application (the “Platform”), owned and operated by Swamika Finnovations Private Limited (CIN U74999TN2022PTC153068), registered office at No. 9, 2nd Cross, Nagratpethpet, Ganigarpet, Bangalore City, Bangalore North, Bengaluru, Karnataka 560002, India (“Company”, “we”, “us”).

This is an electronic record under the Information Technology Act, 2000 and the rules made under it. It is published in line with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. It does not require a physical signature.

If you do not agree, do not create an account and do not buy metal. Using the Platform means you accept these Terms, the Privacy Policy, the Refund and Cancellation Policy, the Shipping and Delivery Policy, and the Risk Disclosure.

1. The service

The Platform lets you buy and sell digital gold and digital silver. We are the merchant for the payment you make on the Platform. The metal is bought from and vaulted by Augmont Goldtech Private Limited (“Custodian”). We are not the vault operator. We do not give investment advice. Quotes, purity, and allocation are subject to the Custodian’s acceptance of the order.

2. Eligibility

  • You must be at least 18 years old and competent to contract under the Indian Contract Act, 1872.
  • You must be resident in India and buying for yourself, not as a business resale, unless we agree otherwise in writing.
  • One person, one account. You must not share your OTP or let another person operate your account.
  • If you become registered under GST, tell us within 24 hours. The service is offered to retail customers.

3. Account and KYC

You register with your mobile number and a one-time password. We may ask for your name, date of birth, address, PAN, and bank account before you buy, sell, or take delivery. PAN and bank details are checked with verification providers and shared with the Custodian so the metal account and sell payout can be created. If information is false or incomplete, we may refuse or close the account.

4. Prices and payment

The binding price is the quote on the order screen when you confirm. Buy prices include GST at 3%. The minimum buy is ₹100 inclusive of GST. Payments are processed by PayU Payments Private Limited. We do not store your UPI PIN or full card number. An order is complete only after payment is captured and the Custodian accepts the allocation. See Pricing and Fees.

5. Sell, delivery, and refunds

After grams are credited, you may sell them at the live sell rate to your verified bank account, or request physical delivery where that product is offered. A captured purchase is not cancelled as a refund of the same payment. Failed or duplicate payments are refunded as set out in the Refund and Cancellation Policy. Delivery follows the Shipping and Delivery Policy.

6. Your responsibilities

  • Pay only from your own bank account or UPI handle.
  • Keep your device, SIM, and OTP secure.
  • Check the quote, grams, and total before you pay.
  • Do not use the Platform for money laundering, fraud, or any unlawful purpose.
  • Do not copy our rates or software for a competing service.

7. No guaranteed return

Gold and silver prices move. We do not promise profit, a fixed return, or that the sell rate will match the buy rate. Sample figures on the website are illustrations. They are not a forecast. Read the Risk Disclosure.

8. Intellectual property

The SwarnaSakhi name, logo, and Platform content belong to the Company or its licensors. You receive a personal, non-transferable right to use the app and website to buy and sell metal. Augmont names and marks belong to the Custodian.

9. Suspension

We may pause a quote, an order, or an account if a payment is flagged, KYC fails, the Custodian rejects the order, or we are required to do so by law. Where we can, we will tell you by SMS or email and let you sell credited metal or receive a refund of an unallocated payment.

10. Liability

The Platform is provided on an “as is” basis. To the extent the law allows, we are not liable for market loss, for a bank or UPI delay, or for a Custodian outage. We do not limit liability for fraud, wilful misconduct, or death or personal injury caused by negligence, or any liability that Indian law does not allow us to limit. Nothing in these Terms removes your rights under the Consumer Protection Act, 2019.

11. Indemnity

You will indemnify the Company against losses arising from your breach of these Terms, a false KYC detail, or your misuse of the Platform, except to the extent the loss is caused by our fraud or wilful misconduct.

12. Changes

We may update these Terms by posting the new version on this page with a new “Last updated” date. Continued use after that date means you accept the update. The current version is dated 9 October 2026.

13. Governing law

These Terms are governed by the laws of India. Courts at Bengaluru, Karnataka, have jurisdiction, without affecting your right to approach a consumer forum. Contact support@swamika.co. Grievances: Grievance Officer.
